The Attorney-General's Chambers (AGC) has responded to criticism over the caning sentence meted out to the two German men who vandalised a train after sneaking into the SMRT Bishan depot. Stressing that Singapore's laws against vandalism are well known, an AGC spokesman said the same standards are applied to everyone.

Last Thursday, Andreas Von Knorre, 22, and Elton Hinz, 21, were sentenced to nine months in jail and three strokes of the cane after pleading guilty. Three times in November, the duo sneaked into the depot through a drain. On their last intrusion on Nov 8, they posed for a picture and spray-painted the left side of a train carriage with graffiti measuring 10m by 1.8m.

A spokesman for the German embassy here said its government "is opposed to corporal punishment anywhere in the world, including in Singapore". International organisation Human Rights Watch (HRW) described caning as a form of torture, adding that Singapore's decision to use it as a punishment is "indicative of a blatant disregard for international human rights standards".

But the AGC, in its response to the embassy spokesman and HRW, rejected this. "Caning is not torture," its spokesman said. "It is carried out in Singapore under strict standards, monitored at all times by a doctor. "The accused persons in this case were vandals who broke the law for their own self-aggrandisement, without consideration of the social costs and the disruptions that their acts would cause to others... "In taking action against them, we are holding them to the same standards as all others, a fundamental principle of justice which we have always abided by."

Most netizens who posted comments on news sites, such as those in Britain and Australia, praised Singapore for its strong stance against vandalism, with several urging their own governments to do the same."

It IS an UNFORTUNATE mischief GONE COMPLETELY WRONG for these 2 'careless' German kids or young persons.

Lessons for me are:

1. what is 'frivolous and harmless' pranks in one nation CAN BE look upon as VERY evil and with disproportionate punishment to go with it! This is WHAT happened here I believe. The German kids simply misjudged the seriousness of their 'pranks'! It would be tragic IF they are aware of what happened to the previous foreigner, a Swiss I believed, who vandalized MRT trains at the same MRT station yard!;

2. it is natural for the German embassy to speak out given that it is, by laws, against corporate punishment. It is even more understandable for Human Rights Watch to be horrified by this 'caning' sentencing. So, it is best to respond calmly and factually by citing the laws of Singapore on vandalism, which is very strict to begin with. In fact, the number of times the 2 kids will get to be caned is actually quite low considering that they did it 3 times and breaching the security of the MRT train station compromised public transportation security. So, the AG Chamber's responses are good. Matter-of-factly and without any emotional responses to the dissenters. In fact, it would have been great HAD it acknowledged that: 'while respect the sentiment and the laws of the great nation, Germany, we are grateful that it respects our laws as well. As for Human Rights Watch, it can turn its attention to other human rights violations in the rest of the world besides this 'caning sentence' to 2 convicted vandals after a free, open and fair trial.';

3. STILL, it is very unfortunate that the 2 German kids got themselves into this jam. Hopefully this experience will NOT scar them for life and that they will not turn into 'Singapore haters' and do truly evil things in the future than just 'sneaked in and vandalised train inventory'! That will be an even worst outcome. Hopefully, they serve their sentences safely and get home to their families and friends peacefully and live their lives they best they can.

Peace to the German. Peace to Singapore. Peace to the human race!!
