Daily Lessons from Life 24 September 2009

A TOP graduate blamed his medical condition for ejaculating on the thigh of a woman in a bus but the judge did not buy it.

Two doctors said Chong Weien, 28, suffers from spontaneous ejaculation and is easily aroused even without any physical stimulation.

This cut no ice with District Judge Jill Tan, who said in her judgement: 'Even if the accused did suffer from a spontaneous ejaculation on the bus, this did not rule out the possibility that he could have brushed his penis against the victim's thigh as well.' "

Well. An interesting judgement. 2 doctors' medical opinions could not influenced the lady District Judge that the 'offender' could have medical ground for whatever he had been accused of. Of course, maybe, there were other evidences that supported her judgement. Whatever it is, it is another case of 'potential' conflict of opinion since the District Judge is of the female gender?

Lessons for me are:

1. judges are free to interpret whatever arguments or evidences presented though there were such things as 'precedence' or what-not!;

2. when it is the 'dark' medical condition involving the offender's physical asset, the medical evidence perhaps, in my untrained legal mind', could have been given more weight. Though it may call for a 2nd or 3rd expertise to confirm the initial assessment!;

3. the story is too short and there are more information that we REALLY need in order to perform a proper diagnosis of the issues before offering any potential solutions!

An unfortunate medical condition that can destroy a man's future! Be careful...
